Terms and Conditions for Listing on a Flat Fee Real Estate Structure
1. Introduction
These Terms and Conditions (“Agreement”) govern the listing of properties under a flat fee real estate structure (“Service”). By using this Service, the property owner (“Seller”) agrees to abide by the terms outlined herein.
2. Service Description
The Service provides the Seller with a listing on a Multiple Listing Service (MLS) or other real estate marketing platforms for a one-time, upfront flat fee. The listing may include descriptions, photographs, and property details provided by the Seller.
3. Seller Responsibilities
A. The Seller must provide accurate, current, and complete property details.
B. The Seller is responsible for ensuring compliance with all applicable local, state, and federal real estate laws.
C. The Seller is responsible for negotiating directly with buyers or their agents unless otherwise agreed upon.
D. The Seller must promptly update any changes in property status (e.g., price changes, pending offers, sale completion).
E. The Seller acknowledges that the Service does not provide legal, financial, or brokerage representation unless stated otherwise.
4. Fees and Payment
A. The flat fee is non-refundable unless explicitly stated in writing by the Service provider. b. Additional services such as enhanced marketing, open house assistance, or document preparation may incur extra charges.
5. Listing Duration and Termination
A. Listings will remain active for the period specified in the agreement.
B. The Seller may request changes to or removal of the listing at any time, subject to processing timeframes.
C. The Service provider reserves the right to terminate a listing if it violates any applicable laws, contains misleading information, or if the Seller breaches this Agreement.
6. Limitation of Liability
A. The Service provider is not responsible for any misrepresentations made by the Seller.
B. The Service provider does not guarantee the sale of the property and is not liable for any losses incurred due to the use of the Service.
C. The Seller agrees to indemnify and hold the Service provider harmless from any claims or disputes arising from the listing.
7. Dispute Resolution
Any disputes arising from this Agreement shall be resolved through mediation or binding arbitration in accordance with the applicable laws of the jurisdiction in which the Service provider operates.
8. Amendments and Modifications
The Service provider reserves the right to update these Terms and Conditions at any time. Sellers will be notified of any significant changes.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the property is listed.
10. Acceptance of Terms
By submitting a listing, the Seller acknowledges and agrees to these Terms and Conditions.
